1. Introduction and Acceptance of Terms
These Terms and Conditions of Use ("Agreement") govern your access to and use of the "My Daily Horoscope" Android application ("App") and the associated website at mydailyhoroscope.biz ("Website"), together referred to as the "Service". The Service is operated by the owner of My Daily Horoscope ("Company", "we", "us", or "our").
By installing, accessing, or using the Service in any way, you ("User" or "you") agree to be bound by this Agreement and all applicable laws and regulations. If you do not agree with any part of these terms, you must not install, access, or use the Service. Using the Service constitutes your legally binding acceptance of this Agreement.
2. Description of the Service
My Daily Horoscope generates and displays daily horoscopes based on a date of birth provided by the user. The Service is provided free of charge and is supported by third-party advertisements. The Service may be changed, restricted, or discontinued at any time without notice.
3. Entertainment Purposes Only - No Guarantee of Accuracy
The Service is provided strictly for entertainment purposes. Horoscopes and any other text, predictions, advice, or statements displayed within the Service:
- are generated automatically, in part by random selection of sentence fragments, and have no scientific, astronomical, or astrological basis;
- are general in nature and not tailored to you as an individual;
- may be inaccurate, incomplete, outdated, or nonsensical;
- do not represent any promise, forecast, or guarantee about future events or about your personality, health, relationships, finances, or luck.
We give no guarantee of any kind regarding the correctness, accuracy, reliability, timeliness, completeness, or usefulness of the horoscopes or any other content of the Service. You should not rely on the content for any purpose.
4. No Professional Advice
The content of the Service does not constitute professional advice of any kind. It is not medical, psychological, psychiatric, financial, investment, legal, relationship, or astrological advice, and it must not be used as a substitute for advice from a qualified professional. Always seek the advice of a qualified professional with any questions you may have regarding a medical, mental-health, financial, or legal matter, and never disregard or delay seeking such advice because of something you read in the Service.
5. Use License
Permission is granted to temporarily view the materials contained in the Service for personal, non-commercial, transitory use only. This is the grant of a license, not a transfer of title. Under this license you may not:
- modify, copy, distribute, or create derivative works based on the materials;
- use the materials for any commercial purpose or for any public display, commercial or non-commercial;
- attempt to decompile, reverse engineer, disassemble, or otherwise reduce to human-readable form any software contained in the Service;
- remove any copyright, trademark, or other proprietary notations from the materials; or
- transfer the materials to another person or "mirror" the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions. Upon termination, you must destroy any downloaded materials in your possession, whether in electronic or printed format.
6. User Responsibilities and Conduct
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or disable anyone else's use of the Service. You are responsible for your own device, internet connection, and any charges (e.g. mobile data) incurred while using the Service. You use the Service at your own risk.
7. Intellectual Property
The content of the Service, including but not limited to text, graphics, logos, icons, images, fonts, and software, is the property of the Company or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. Nothing in this Agreement grants you any right, title, or interest in the Service or its content, except for the limited use license set out above.
8. Third-Party Services, Advertisements and Links
The Service displays advertisements from third-party advertising networks served through the Unity LevelPlay (IronSource) ad mediation platform, and may use third-party analytics and crash-reporting services (such as Firebase). These third parties may collect device and usage data as described in our Privacy Policy. The Service may also contain links to external websites that are not operated or controlled by us. We have no control over and assume no responsibility for the content, privacy practices, or policies of any third-party site or service. The inclusion of a link or advertisement does not imply endorsement. Your interaction with any third-party site or advertisement is solely between you and that third party.
9. Disclaimer of Warranties
The Service and all materials contained in it are provided "as is" and "as available", with all faults. To the fullest extent permitted by applicable law, we hereby disclaim and negate all warranties of any kind, whether express or implied, including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement of intellectual property or other rights. We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected.
10. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall the Company, its owner, affiliates, officers, directors, employees, agents, licensors, suppliers, or partners be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, revenue, data, or goodwill, business interruption, personal injury, or any other damages or losses, arising out of or in any way connected with your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.
You acknowledge and agree that you use the Service entirely at your own risk and that you are solely responsible for any decision you make based on the content of the Service. Because some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, some of the above limitations may not apply to you to the extent prohibited by law, in which case our liability shall be limited to the maximum extent permitted by such law.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its owner, affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, expenses, and costs, including reasonable attorneys' fees, arising out of your use of or inability to use the Service, your violation of this Agreement, or your violation of any rights of another party.
12. Availability and Maintenance
The Service is provided on an "as available" basis. We do not guarantee continuous, uninterrupted, or secure access. We may modify, suspend, restrict, or discontinue the Service, or any part of it, at any time, for any reason, and without notice or liability. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service.
13. Revisions and Errata
The materials appearing in the Service may include technical, typographical, or photographic errors. We do not warrant that the materials are accurate, complete, or current. We may make changes to the materials at any time without notice and do not commit to updating them.
14. Amendments to this Agreement
We may revise this Agreement at any time, at our sole discretion, without notice. By continuing to access or use the Service after revisions become effective, you agree to be bound by the then-current version. It is your responsibility to review this Agreement periodically. The effective date indicated above reflects the most recent revision.
15. Termination
This Agreement is effective until terminated. You may terminate it at any time by uninstalling the App and ceasing to use the Website. We may terminate or restrict your access to the Service at any time, without notice, for any reason. Upon termination, all licenses granted to you under this Agreement shall immediately cease. Sections that by their nature should survive termination shall survive, including sections on disclaimers, limitation of liability, indemnification, and governing law.
16. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any dispute arising out of or relating to this Agreement or the Service shall be subject to the exclusive jurisdiction of the courts of the canton of Zurich, Switzerland.
17. Entire Agreement
This Agreement constitutes the entire agreement between you and the Company regarding the use of the Service and supersedes any prior or contemporaneous understandings, communications, or agreements, written or oral, regarding that subject matter.
